S P E C T R U M Rules and Regulations
1. Terms: Strict compliance with the terms of this Contract is necessary for the success of the expo.
2. Deposits and Payments: An exhibitor who fails to make payments when due automatically forfeits any rights, privileges, and claims the Exhibitor may have, including payments previously made.
3. Cancellations: All cancellations must be in writing and will be dated as of receipt by SIBE. Upon Cancellation, SIBE has the right to resell the space.
4. Services: SIBE has contracted with a photographer to provide photography and audiovisual services at the Exhibitor’s expense.
5. Use of Exhibit: The Exhibitor is responsible for the set up and removal of their exhibit area. Tacking, nailing, or otherwise attaching materials to walls, floors or other parts of the hotel are prohibited. The Exhibitor may not use materials that may damage the walls, floors, or other parts of the hotel. The Exhibitor shall be responsible for charges assessed against SIBE by the hotel relating to dismantling of an exhibit, removal of excessive debris left behind by the Exhibitor, or damage to the hotel by an exhibit.
6. Equipment and Display: All demonstrations or other promotional activities must be confined to the Exhibitors classroom or space. Promotional literature or items may be distributed only within the classroom or exhibit area. SIBE reserves the right to restrict, reject, or expel exhibits, which because of noise, operation, materials or any other reason are deemed objectionable in SIBE’S judgment. SIBE may prohibit or remove any exhibit, which, in the sole opinion of SIBE, distracts from the general character of SIBE, or is incompatible with the purpose of the expo.
Restrictions or removal for any reason shall be at the Exhibitor’s expense, and SIBE shall not be liable for refunds or other exhibit expenses.
SIBE is an event for industry professionals and students only, therefore, 100% of the products displayed in the Exhibitors classroom or exhibit area must relate to the professional cosmetology industry. Those Exhibitors not complying with this regulation will be removed from the show.
7. Classroom sharing or subletting: No sharing or subletting of classroom or exhibit space is allowed without the written consent of SIBE.
8. Exhibit Hours: All classrooms and rental space shall be fully staffed during Exhibit hours. If the Exhibitor does not keep its exhibit open and staffed at all times during official exhibit hours, The Exhibitor may be denied a classroom or space in future years.
9. It is understood that all products, equipment, furniture and furnishings of the Exhibit are placed at the sole risk of the Exhibitor, and SIBE will not assume any responsibility for the loss or damage to the Exhibitor’s property.
10. Indemnification: The Exhibitor shall hold harmless SIBE and the hotel for any claims, loss, damage liability or expense including reasonable attorney fees, relating to any personal injury or death, or property damage, or claim arising from a violation of these rules or any contract breach by the Exhibitor, except for liability or loss resulting from the sole negligence of SIBE or the hotel.
11. Insurance: Exhibitor must supply SIBE with proof of the following insurance no later than 30 days before the start of the event: Worker’s Compensation, commercial general liability, including products and complete operations, independent contractors, personal injury, and a blanket contractual liability insurance of at least $500,000 per occurrence, $500.00 aggregate. The proof of insurance shall be a Certificate of Insurance with a 30-day notice of cancellation provision to the holder, and shall name SIBE as additional insured. Exhibitors also are encouraged to have sufficient insurance coverage protecting their property while at and in transit to and from SIBE.
12. Taxes: The Exhibitor shall pay, or reimburse SIBE if they shall have to pay all taxes resulting from the display of merchandise, and taking of order or related Expo activities, no matter how the taxes are designated or levied.
13. Acts of God: Neither SIBE or the hotel is liable if their failure to provide a classroom or space or otherwise perform under this contract is due to fire, war, terrorism, strikes, flood, earthquake, riots, legal order, or cancellation of this show for any cause beyond the control of the expo.
14. Miscellaneous: All points covered herein are subject to the discretion and control of SIBE. SIBE reserves the right to change the floor plan. SIBE reserves the right to cancel this contract at any time during the event if any product exhibited hereunder is misrepresented. The Exhibitor is bound by all applicable state and municipal codes, regulations and laws. The Exhibitor is bound by the rules and regulations of the hotel as administered by the hotel owners and operators. The laws of the State of California govern this contract, and the Exhibitor agrees to the jurisdiction of the courts of the State of California in the event of any legal dispute arising out of or related to this contract.
